Terms of Use

1. Purpose

These terms of use (the "Terms") govern access to and use of the Karyo mobile application and website (the "Platform"), published by the company CKK Labs ("CKK Labs", "we", "us"). Karyo is a classified-ads platform that connects sellers and buyers of vehicles (cars and motorbikes) in Morocco.

By accessing or using the Platform, you (the "User") acknowledge that you have read, understood and unreservedly accepted these Terms. If you do not accept them, you must stop using the Platform.

2. Definitions

• Platform: the Karyo mobile application and the karyo.ma website, together with all their features.
• User: any person who accesses the Platform, whether registered or not.
• Seller: a User who publishes a listing in order to sell a vehicle.
• Buyer: a User who views listings or contacts a Seller.
• Listing: any content published by a Seller (text, photos, price, specifications) to present a vehicle.
• Content: any data, text, image or information published on the Platform by a User.

3. Acceptance and modification of the Terms

Using the Platform constitutes full acceptance of these Terms. We reserve the right to modify the Terms at any time to reflect changes to the Platform or to applicable regulations. Modifications take effect upon publication. In the event of a substantial modification, registered Users are informed by an appropriate means (in-app notification or e-mail). Continued use of the Platform after the modifications take effect constitutes acceptance of the new Terms.

4. Registration and account

Access to certain features (publishing listings, favourites, alerts) requires creating an account.

• Registration is reserved for natural persons aged at least 18 and with legal capacity, as well as legal entities acting through an authorised representative.
• You undertake to provide accurate, complete and up-to-date information, and to update it if it changes.
• You are solely responsible for keeping your login credentials confidential and for any activity carried out from your account. Any verification code (OTP) received by WhatsApp or e-mail is strictly personal and must never be shared with a third party.
• A User may hold only one account, unless we expressly authorise otherwise.
• You may delete your account at any time under the conditions described on the "Delete my account" page.

5. Karyo's role: a mere technical intermediary

Karyo acts exclusively as a technical host and as an intermediary that connects users. This point is essential to understanding these Terms:

• Karyo is never a party to the transactions concluded between Users. The Platform is limited to hosting listings and enabling contact between a Seller and a Buyer.
• Karyo does not sell, buy, appraise or warrant any vehicle. We are neither an agent, broker, custodian, nor insurer of the vehicles presented.
• Karyo does not take part in negotiation, price setting, inspection, payment, handover of the vehicle, or any step of the sale. No payment is collected by Karyo and no transaction is carried out on the Platform.
• Karyo does not verify the real identity of Users, the accuracy of listings, the mechanical or administrative condition of vehicles, or the Seller's ownership of or right to sell the vehicle. The moderation operations described in article 8 constitute neither an exhaustive check nor a warranty.
• The sale, its contract, its legal warranties and its performance are the sole responsibility of the Seller and the Buyer, who bear all related risks.

It is up to each User to carry out all necessary checks (vehicle documents, technical inspection, administrative status, test drive, inspection by a professional) before concluding a transaction. We invite Users to read our "Safety tips" and "How it works" pages.

6. Publishing listings

By publishing a Listing, the Seller warrants that:

• they are the owner of the vehicle or duly authorised to sell it;
• the information provided (specifications, mileage, year, condition, price, documents) is accurate, truthful and not misleading;
• the photos correspond to the vehicle actually offered;
• the vehicle is in good administrative standing and may lawfully be sold.

The Seller is solely responsible for the content of their Listings and for the consequences of their publication. A Listing does not constitute a binding offer in the legal sense; it is an invitation to make contact.

Listing rules

To ensure clear and reliable listings, each Seller undertakes to comply with the following rules:

• One listing per vehicle: the same vehicle may not be the subject of several simultaneous listings; duplicates may be removed.
• Mandatory information: the listing must indicate at least the make, model, year, mileage, condition and a real price (except where the "price on request" option is offered). The displayed price must correspond to the price actually requested.
• Authentic photos: photos must represent the vehicle actually offered; generic, misleading or third-party images are prohibited.
• Correct category: the listing must be published in the right category (car or motorbike) and describe an eligible vehicle.
• No circumvention: it is prohibited to insert in the text or photos any element intended to bypass the Platform (external links, redirects to other sites, advertising).
• Clarity: the description must be understandable and free of content unrelated to the vehicle.

Any listing that does not comply with these rules may be modified, unpublished or removed without notice.

7. Prohibited content and listings

It is prohibited to publish or distribute on the Platform:

• listings for vehicles that are stolen, pledged, subject to an objection, or lacking the required legal documents;
• false, misleading or fraudulent listings, or listings with a manifestly incorrect price intended to attract contact;
• content contrary to the law, public order or morality, or that is defamatory, insulting, violent, hateful, discriminatory or infringes the rights of third parties;
• goods other than eligible vehicles, counterfeits, or any good or service whose sale is regulated or prohibited;
• duplicate listings, unsolicited advertising content (spam), or elements that redirect Users to external services;
• the personal data of third parties without their consent.

8. Moderation

We reserve the right, without being obliged to and without notice, to refuse, moderate, suspend or remove any Listing or Content that does not comply with these Terms or the law, and to suspend or close any account in the event of a breach.

Moderation may be carried out by automated means (including analysis and artificial-intelligence systems) and/or by humans. Karyo is not subject to a general obligation to monitor content, but acts diligently upon report.

Reporting illegal content

Any User may report a listing they consider illegal or contrary to these Terms:

• From the Platform: using the "Report" function available on the listing concerned;
• By e-mail: by writing to [email protected].

To allow efficient processing, the report must specify the listing concerned (link or identifier), the reason for the report and any useful information. After review, we may remove the content, suspend the account concerned or take any appropriate measure. We reserve the right not to act on a manifestly unfounded or abusive report. Karyo cooperates with the competent authorities upon lawful request.

9. User obligations

The User undertakes to:

• use the Platform in good faith, in accordance with its purpose and the law;
• not infringe the rights of other Users or those of Karyo;
• not extract, copy or reuse the Platform's data in bulk or in an automated manner (scraping), nor disrupt its operation;
• not impersonate a third party or spread false information;
• respect the confidentiality of exchanges and use the contact details obtained only in the context of a legitimate connection.

10. Intellectual property

The Platform, its "Karyo" brand, logos, interface, databases and all of its elements are the exclusive property of CKK Labs or its partners and are protected by intellectual property law. Any unauthorised reproduction or use is prohibited.

By publishing Content, the User grants CKK Labs a non-exclusive, free licence to use, reproduce and display that Content, for the purposes of operating and promoting the Platform, for the duration of its publication.

11. Personal data

The processing of Users' personal data is governed by our Privacy Policy, in accordance with Law No. 09-08 on the protection of individuals with regard to the processing of personal data.

12. Warranties and liability

The Platform is provided "as is" and according to its availability. To the extent permitted by law:

• Karyo gives no warranty as to the accuracy, quality, lawfulness or availability of the Listings and Content published by Users, nor as to the completion or regularity of a transaction.
• Karyo cannot be held liable for damages resulting from relationships between Users, from the conclusion or performance of a sale, from the condition or legal status of a vehicle, from a User's conduct, from fraud, a scam or a dispute between a Seller and a Buyer.
• Karyo does not guarantee uninterrupted or error-free operation of the Platform and cannot be held liable for interruptions, unavailability, data loss or indirect damages.
• Karyo's liability cannot be engaged in the event of force majeure or an event beyond its reasonable control.

The User personally handles any dispute arising from a transaction and indemnifies Karyo against any third-party claim resulting from their Content or their use of the Platform.

13. Price estimation

The Platform may offer an indicative price estimate, generated by a statistical model. This estimate does not constitute an appraisal, a professional valuation or an offer. It is provided for information purposes only and does not engage Karyo's liability in any way. The price of a vehicle is freely negotiated between the parties. 14. Suspension and termination

The User may stop using the Platform and delete their account at any time. We may suspend or close an account, without notice, in the event of a breach of these Terms, fraudulent or abusive conduct, or for security reasons.

15. Links and third-party services

The Platform may link to third-party services (for example WhatsApp for making contact). Karyo exercises no control over these services and disclaims any liability for their content or operation.

16. Governing law and jurisdiction

These Terms are governed by Moroccan law. Any dispute relating to their interpretation or performance falls within the exclusive jurisdiction of the competent courts of Casablanca, failing amicable resolution.
